1.1 These are the terms and conditions on which we will supply our food and drink to you (our “Items”) and how you can use our website.
1.2 Please read these terms carefully before you use our website or submit an order to us.
1.3 We may revise these terms at any time by amending this page. Please check this page from time to time to take notice of any changes we make, as they are binding on you.
2. Information About Us
2.1 The website found at www.oleandsteen.co.uk (our “website”) is owned and operated by Danish Bake UK Limited of 17-18 Aylesbury Street, London, United Kingdom, EC1R 0DB trading as Ole & Steen (“us” or “we”). We sell our Items through our website and in Ole & Steen stores in the UK (our “Stores”).
2.2 For details on how to contact us please see section 13.
3. Our Contract with You
3.1 Our acceptance of your order will take place when we email you with your order number, at which point a contract will come into existence between you and us.
3.2 If you do not receive an email with your order number within 5 minutes of submitting an order it means we were unable to accept it. If this is the case we will not charge you for the Items. This might be because we are out of stock, have identified an error in the price or description of the Items or because we are unable to meet a delivery deadline you have specified.
3.3 Our website is solely for the promotion of our Items in the UK. Unfortunately, we do not deliver outside the catchment area detailed on our website.
4. Delivery or Collection of the Items
4.1 We will not charge you for delivery of your Items.
4.2 If you are in our catchment area (see 3) you will be able to choose a time for delivery in accordance with the options you are presented with. This will usually be a 30 minute slot at least one hour after your order is accepted.
4.3 If you are collecting the Items from a Store you can choose the time and date for pickup of the order. Your order will typically be available within 5 minutes of the chosen pick-up time. In cases where the order is not ready for pickup at the Store you have chosen, we will pack and ready the order as soon as we can after you arrive in the Store.
4.4 If you decide to register on our website you can track purchases you have made through it. Once logged in you will see a digital receipt of every purchase made by clicking “previous purchases”.
5. Price and Payment
5.1 The price of the Items will be the price indicated on the order pages when you placed your order.
5.2 It is always possible that, despite our best efforts, some of the Items we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the Item’s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the Item’s correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order.
5.3 We accept payment with most regular payment cards, such as VISA, MasterCard, VISA electro or American Express. You must pay for the Items before we start making your order. We will not charge your credit or debit card until your Items have been dispatched.
5.4 Our payment partner Shopify Inc (“Shopify”) is responsible on our behalf for security in regards to the payment card information and data you provide to us.
5.5 We will not be in possession of your payment card information, Shopify alone will store and handle it. Shopify stores such information in a PCI compliant environment and your payment card information is stored only as long as it is necessary to complete your transaction. 6. Cancelling Orders
6.1 Please make sure that you are happy with your order before you submit it. Due to the fact that we will be making your order fresh, and the Items are “perishable”, we are unable to offer refunds for orders cancelled on the day they are due for delivery or pick up. The only circumstances in which you can cancel an order is if you let us know by telephone (Find phone number to your local bakery here) by 8pm the day before we are due to deliver the Items or you are due to collect them from our Store.
7. Our Items
7.1 The images of the Items on our website are for illustrative purposes only. Although we have made every effort to display them accurately, as they are made fresh everyday, your Items may vary slightly from those images.
8. Our Liability to You
8.1 When using our website, or when ordering Items, we do not have any liability to you for any direct, indirect, special or consequential losses or damages arising in contract, tort (including negligence) or otherwise arising from use of our website or your purchase of Items.
8.2 In the event we are found to be liable to you for any reason our total aggregate liability is limited to the purchase price in your order. This does not include or limit in any way our liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation.
9. How We May Use your Personal Information
9.1 By ordering or registering on our website you grant us permission to process the data you provide us with for the purpose of processing your order and supplying the Items to you.
9.2 When ordering or registering we may collect the following information:
(a) your personal information and the total amount of Items you have ordered;
(b) payment card information; and
(c) your mobile phone number.
9.3 When a debit or credit card is used for purchases on our website we may collect and process the following information:
(a) the purchases made, including total amount of Items you have ordered;
(b) your ongoing use of our website; and
(c) your purchasing history.
9.4 This information is used in order for us to track your order and to make suggestions and recommendations to you about our Items or services that may interest you.
9.5 Additionally, we may use the information you provide us with for:
(a) collecting anonymized statistics to help us develop our Stores, Items, offers and other business operating initiatives; and
(b) sharing your anonymized information with business partners.
9.6 Data will be shared with our data processors, eg. Shopify as described in section 5. This is solely for the purpose described in this section 9. Our contracts with data processors ensure that personal data is handled in accordance with our instructions only and in compliance with data protection law.
9.7 You have the right to ask us not to process your personal data for the purposes of sending you marketing communications. You can at any time exercise your right to prevent such processing by emailing us with “UNSUBSCRIBE” in the subject line or by writing to us at the address above, giving us details of your email address, and requesting to be unsubscribed from our communications.
9.8 You can at any time request access to the information about you that we have in our possession by contacting us at the email address at section 13.

10.1 We are the owner or the licensee of all intellectual property rights in our website, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
10.2 Where our website contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources.
10.3 The content on our website is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our website.
10.4 We do not guarantee that our website, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.
11.1 We reserve the right to “unregister” you if your account has been inactive for 12 consecutive months. “Inactive” means that you have not logged onto our website in that time.
11.2 Neither of us shall be responsible to the other for any delay or non-performance of our obligations under these terms arising from any cause beyond our control including, without limitation, any of the following: act of God, governmental act, war, fire, flood, explosion or civil commotion.
11.3 These terms contain the whole agreement between us and supersede all prior agreements, arrangements and understandings between us.
11.4 These terms and any matters arising out of them shall be governed by English law and the laws of England and Wales shall have exclusive jurisdiction in respect of any matter arising out of them.

12.1 None of these terms affects any of your statutory rights as a consumer.

Marketing Terms & Conditions
Eat Out to Help Out - August 2020.
Summary of the offer: Ole & Steen are participating the government eat out to help out scheme. This entitles diners who eat in a 50 % discount on food or non-alcoholic drinks, up the to value of £10 per diner every Monday, Tuesday and Wednesday in August.
Offer available on Monday 3rd, Tuesday 4th, Wednesday 5th, Monday 10th, Tuesday 11th, Wednesday 12th, Monday 17th, Tuesday 18th, Wednesday 19th, Monday 24th, Tuesday 25th, Wednesday 26th and Monday 31st August 2020, only. The offer entitles you to 50% off your eat-in transaction, up to a maximum discount of £10 per person, as part of the Government’s Eat Out to Help out scheme. Offer not applicable on alcoholic drinks or service charges. This offer can only be used for Eat In transactions and is not available for takeaway items. If there is not enough seating at the time a party arrives, the establishment is not required to provide the discount on takeaway items. Diners cannot make multiple purchases in the same seating to receive extra discounts. There is no minimum or maximum spend. There is no minimum or maximum party size. Transactions containing groups of more than 1 person will need to inform the cashier of how many are dining in order to receive the correct discount. Customers can use this at the same time as other discounts and offers. Vouchers are not required to use the discount. The discount will not be applied outside any of the dates stated above. Subject to availability. No cash value. This offer is non-transferable. Delivery not included. This offer is at the manager’s discretion and may be withdrawn at any time.
NHS Blue Light 50% discount
This dicount is available for all NHS and bluelight staff who are able to provide identification. This discount cannot be used in conjunction with any other offer. Offer not applicable on alcoholic drinks or service charges. This offer can only be used for takeaway items and is not available for Eat In transactions. Discount must be provided at the time of purchase, we are unable to provide a discount or refund after purchase has taken place. It is the responsibility of the customer to provide their ID card or Bluelight card to the cashier. Cashiers do not hold the responsibility to ask if a customer is eligible for the discount. Subject to availability. No cash value. This offer is non-transferable. Delivery not included. Valid across all open sites. There is no minimum or maximum spend. There is no minimum or maximum party size. This offer is at the manager’s discretion and may be withdrawn at any time.

We are offering a free Cinnamon Social slice (single portion) for all new app user sign ups. This is valid for customers who download the Ole & Steen app, input their bank card details and consent to marketing communications (My profile > Consents, terms & conditions > Update consent). The offer is valid for anyone signing up to the app between Wednesday 7th October and Tuesday 20th October. The user has until the close of business on Tuesday 20th October to redeem their offer.
This offer is valid across all open sites to any customer who has the voucher available on their Ole & Steen App. This offer will only be recognized when a physical bank card is used, third party payments will not be accepted (Apple Pay, Google Pay etc.)These are offered on a first come first serve basis subject to availability. This offer is available on Cinnamon Social slices only- no substitutions or swaps are available. This offer is at the managers discretions, has no cash value and is not valid via delivery or the Ole & Steen app. Takeaway and Eat In, only. The offer is valid for one Cinnamon Social slice for each valid voucher. Once the voucher is used it cannot be used again. Free hot drink for current app users
We are offering a free hot drink for all current app users. This is valid for customers who have already downloaded the Ole & Steen app, inputted their bank card details and accepted consent to marketing communications (My profile > Consents, terms & conditions > Update consent). Those who have not consented to marketing communications will not receive this voucher. The offer is valid for anyone signing up to the app between Wednesday 7th October and Tuesday 20th October. This offer will only be recognized when a physical bank card is used, third party payments will not be accepted (Apple Pay, Google Pay etc.) The user has until the close of business on Tuesday 20th October to redeem their offer.
This offer is valid across all open sites to any customer who has the voucher available on their Ole & Steen App. These are offered on a first come first serve basis subject to availability. £5 voucher for consumer survey feedback
We are offering a £5 e-voucher for a maximum of 1,000 customers who complete a survey. The survey is powered by Survey Monkey. The e-voucher is powered by Toggle. Recipients have been chosen at random from a list in our email database.
The voucher is for the retail value of £5 and has an expiration date of 31.12.20. The voucher can be used across all open sites. Subject to availability. No substitutions or swaps are available. The voucher is subject to the managers discretion, has no cash value and is not valid via delivery or the Ole & Steen app. Takeaway and Eat In, only. The voucher cannot be used as part-payment so you’ll need the full cash amount for the product you choose. For example, if you have £1 remaining on your card, you will only be able to use this against an item of a £1 or less value. Please note that the card cannot be topped up.
